We seem to be going round in circles. Its not a crime, there is no element of dole or culpa. Copyright is a civil right. Liability is strict. The questions are is the work copyrightable, and if so, have no ifnringed the owners copyright by copying, in whole or in part, or otherwise dealing with the material.
At least in the UK paraody is not a defence to a civil claim, incidental inclusion and news reporting may result in unlicensed copying but a web comic doesn’t.
The issue is whether or not the representation of gtg copies GW’s ip. Then you get into the territory where you have to argue that the represnetation the the Ork’s form was created by GW, and I don’t get paid enough to argue that point.

Lastly Sly Marbo is a rip of Rambo, as was the previous hive tyrant from Aliens, the difference was the tyrant looked similar, Marbo is just the theme, the idea isn’t protected so Marbo lives on whoe we have a new tyrant.
